Terms of Service — TxHealthspan, LLC

1. Introduction & Acceptance

Welcome to TxHealthspan, LLC. By using our website and telehealth services, you agree to these Terms of Service (“ToS”). If you do not agree, please do not use our services.

2. Eligibility & Licensing

  • All telehealth services, including consultations, prescriptions, and Good Faith Exams (GFEs), are conducted by licensed Texas practitioners (e.g., MD, DO, NP, PA), as required by Texas law. Texas permits GFEs via telehealth when conducted by authorized licensees.
  • We verify that all providers hold current, appropriate licenses to practice and prescribe in Texas.

3. Medical Disclaimer

  • All services are for general and cosmetic purposes only. No guarantees of results are implied.
  • Emergencies—if you’re experiencing an urgent medical condition, call 911 immediately.

4. Telehealth-Specific Terms

  • Telehealth visits are real-time and conducted via HIPAA-compliant platforms.
  • You must complete a Good Faith Exam (GFE) via telehealth before receiving treatments or prescriptions. These exams are securely documented.

5. Provider Eligibility & Geographic Restrictions

  • All telehealth services—including Good Faith Exams (GFEs), consultations, or prescriptions—are provided only to patients physically located within the state of Texas at the time of the encounter.
  • Dr. Jeffrey Cain, or any other licensed provider affiliated with this med spa, is fully licensed in Texas and may only provide telehealth services to patients located in Texas. This is required by the Texas Medical Board’s telemedicine regulations.

6. Prescriptions & Dispensing

  • Prescribing follows applicable Texas laws. Any dispensed medications are sourced from licensed pharmacies or providers in compliance with chain-of-custody regulations.
  • All prescriptions are dispensed through legitimate, authorized pharmacies that are either LegitScript-certified or NABP-accredited.

7. Product Sourcing & Compliance

  • All products (e.g., injectables, IV solutions, supplements) used are FDA-approved or sourced from authorized distributors. No gray-market or counterfeit items.

8. Advertising & Claims

  • All marketing and treatment claims are truthful, fact-based, and supported by medical evidence. We avoid sensational, misleading, or unsubstantiated claims.

9. Patient Privacy & Data Security

  • We comply with HIPAA and Texas privacy laws. All patient health information (PHI) is encrypted, securely stored, and only accessed by authorized staff.
  • Our privacy policy details how we collect, store, use, and protect your data.

10. Informed Consent

  • Before any service, you must provide informed consent, acknowledging understanding of procedures, risks, benefits, and alternatives.

11. Payment & Billing

  • Telehealth consultations and dispensations are billed clearly. We provide transparent cost estimates before confirming services.

12. Domain Registration & Contact Info

  • Our website’s domain registration displays valid, non-privacy-protected contact details (name, address, email, phone) to ensure transparency.

13. Disciplinary Action & Compliance Record

  • We commit to providing documentation of any provider disciplinary history, FDA inspection reports, or corrective action plans within the last 10 years, if applicable.

14. Affiliate & Partner Oversight

  • All affiliates, including pharmacies or marketing partners, are vetted for legal compliance. Affiliations involving unapproved products (e.g., peptides, ozone therapy) are prohibited.

15. Compounded Products

  • If we offer IV infusions, we provide supplier documentation demonstrating regulatory compliance.

16. Termination & Suspension

  • We may suspend or terminate service for non-compliance, misuse, or violation of these ToS.

17. Changes to the ToS

  • We reserve the right to update these Terms. We will notify users of material changes and the revised ToS will reflect the updated date.

18. Governing Law & Disputes

  • These ToS are governed by Texas law. Any disputes will be resolved in courts located within Texas.
